Fair Use Policy

VpsCity offers hosting packages bundled with limited or unlimited resources like disk space and/or other resources, such as data transfer, email accounts, databases etc. The use of VpsCity’s products and services are governed by a Fair Use Policy, stated here, which covers the fair use of bandwidth and other resources on shared and reseller hosting plans, where there is an indication of “Unmetered/Unlimited” data transfer or, storage capacity.

The term “Unlimited” or, “Unmetered”

VpsCity helps you to create large websites without worrying about a ceiling or in other words, the upper limit. It provides for unlimited space usage and bandwidth that allows you to add any amount of content to your website. But how can VpsCity give unlimited webspace? The actual concept is that we do not give unlimited hard disk space, we are giving unlimited usage of web space. It means that if you use 10GB space then we will add more hard disk to our server or we will add a new server if required and as such will fulfil your unlimited resource requirements.

When you use the service provided by VpsCity, the visitors of your website also stand to benefit from it. They are able to view unlimited content and pages on your website. The server allows for unlimited data transfer as well. You can add more content every month and enjoy unlimited disk space and data transfer.

It has been noticed that people who make use of VpsCity are able to gain unlimited disk space and bandwidth. But this is subject to appropriate usage policies. However, VpsCity has certain constraints related to the type of material that may be added to your website. The server does not allow you to upload unnecessary pirated software, unnecessary audio or video files.

The Following (including but not limited to), is NOT PERMITTED

1. Use of account as massive file storage, or in other words, as a space for files that are not elements of your website.
2. Use of account as large backup store.
3. Storage of mass amounts of file archives (such as zip,rar,gzip,7z etc), video files, audio files, documents, log files etc. if those are not related to your websites.
4. Hosting high resource intensive web portals under shared hosting. In such cases consider upgrading the account to dedicated hosting, vm/vps/dedicated server plan
5. Mass newsletter subscription based services. Consider business email hosting or a vps/dedicated server
6. FTP or file sharing services.
7. Use of hosting as a “mirror” for other websites.
8. Sharing of your account with a 3rd party without consent.
9. Reselling of personal accounts or, offering large amounts of free web hosting services except accounts hosted under reseller packages or, vm/vps/dedicated servers

Illegal Activity

Customers may only use VpsCity web hosting’s servers for lawful purposes. Transmission of any material in violation of any country, state or local regulation is prohibited. To this effect, child pornography is strictly prohibited as well as housing any copyrighted information (to which the customer does not hold the copyright or an appropriate license). Also, using VpsCity’s servers or network to conspire to commit or support the commission of illegal activities is forbidden as well. Illegal content including, but not limited to pirated software, music, films, applications or other media stored in any file formats or extension. Having high-limits or unlimited access to resources does not mean, that you can use your account in such a way that it negatively affects the server performance. VpsCity reserves the right to limit users to a lower resource limit to preserve the effectiveness of the service for all users.

Abusive Scripts/Processes

Any script/process/etc that adversely affects the ability of any other customer to satisfactorily use their provided services is forbidden. This includes, but is not limited to, CPU-intensive CGI/PHP scripts and websites for which the scale of traffic has exceeded the acceptable limits of a shared/reseller hosting environment.

What files can I store on the web-server?

As long as your files tie directly into your website, are legal under applicable laws, and are linked to and displayed on your website, then you can store them on your account. Where possible issues arise is when one user attempts to offload all of their storage needs onto the web-server. It’s important to realise that a web-server, and our hosting network is optimised to handle website related files. The service is not a mass file storage one like Google Drive, Dropbox etc.

For instance if you have a folder with 25GB worth of pictures you’ve taken with your camera over the years. simply uploading these thousands upon thousands of images to your /public_ftp directory for storage is not related to your website. At that point you would simply be utilising the web-server as a file repository. THIS IS NOT ACCEPTABLE!

Why don’t I want to store everything on the web-server?

One important factor why you don’t want to clutter up your web-hosting account with un-related files is that our automatic remote backup service needs to backup all these files each day and may incur additional charges to you if the storage usage is excessive.

As a shared-hosting customer you share the total web-server resources such as disk space with other customers. As such if everyone decided to upload all of their home photos to the web-server, things could quickly fill up, and you might not have room to store actual website related content.

Also last but not least, there are storage services available online where the specific purpose of those networks are to store mass volumes of backup data. Offloading your online storage needs to these types of services is generally easier to manage and keep track of than managing your files over on shared hosting.

Hey, that doesn’t sound very “Unlimited” to me!

Actually, for you, "legitimate website owner", it is unlimited. This whole page is just to announce to the <1% of people who want to try and run free porn affiliate sites or anime video trading forums or host pirated rips or use the service as a file store on our servers that we will not tolerate it, but our pledge to you is to do our best to always keep your website, with the content you created online and performing as expected.

Resource Fair Usage Policies

It is acknowledged that any single account is entitled to utilise the server resources, within reason, up to what is allotted or by what is physically available. If resources become scarce, VpsCity reserves the right to limit users of the affected machine to a lower limit to preserve the effectiveness of the service for all users. If a particular user is in extreme excess of what the average users of the machine have in use (actually used) of their resource allotments, that customer may be asked to remove content, cut resource usage, or relocate to a dedicated/vps server. This policy only applies to web sites that are considered to be abusive in service, disk space or resource consumption and where it is evident that the fair-use of resources among customers has been breached, particularly in regards to disk space, bandwidth or CPU processing power utilisation. Web sites that are found to contain either/or no html documents, a large number of unlinked files are subject to warning, suspension or cancellation at the sole discretion of VpsCity.

If a Fair-Usage breach occurs, whose determination within reason is solely up to VpsCity, a subscriber may have to remove files from or reduce access to the subscribers account to an extent as determined by VpsCity, in order to restore full serviceability to other subscribers affected by the breach. In any case, the subscriber will be notified of any actions that VpsCity may have to take.

VpsCity shared Web Hosting Plans have a maximum single file size of 1GB to prevent the service from being used as a file transfer facility.

In order to ensure a consistent and quality experience for all subscribers, VpsCity does place automated safeguards to protect against any one site growing too quickly and adversely impacting the system until VpsCity can evaluate said sites resource needs. VpsCity reserves the right to limit processor time, bandwidth, or processes in cases where it is necessary to prevent negatively impacting other subscribers.

Bandwidth Fair Usage Policies

VpsCity provides unmetered data on VPS, Cloud Servers, Shared/Reseller Hosting, Colocation and Dedicated Server packages which offer generous fair use data transfer. Data transfer covers bandwidth usage Nationally (New Zealand) per month unless otherwise stated as is the case with our Colocation and Dedicated Server plans where this bandwidth policy extends to International data. This bandwidth for Colocation and Dedicated Server plans provides customers with up to 500GB of International data transfer per month as they wish to use without any additional charge.

Customers may use this data for any purpose other than those unacceptable as stated in our Acceptable Use Policy. Customers will receive a notice warning upon reaching 80% of their International allowance. Usage beyond this limit will incur a charge of $2.00 NZD per 1GB of International data transferred (pro-rated to usage). Your server will be limited to 128kb/s for both National and International traffic. Please contact our Support Desk should you wish to purchase an additional data pack.

Should VpsCity deem a customers account as exceeding fair use bandwidth consumption which causes interference with other users, VpsCity will notify the customer and allow the customer to remedy the problem. However, should a customers bandwidth usage be significantly greater than fair use, VpsCity reserves the right to suspend or throttle the customers account where appropriate.

General

VpsCity will not be responsible for any damages your business may suffer. VpsCity makes no warranties of any kind, expressed or implied for services we provide. VpsCity disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by VpsCity and its employees.

If, in our reasonable opinion, you have breached this FUP, we will contact you by email to let you know that your usage is excessive and is affecting VpsCity services/systems and/or other users. We reserve the right to impose reasonable limits to reduce your usage and/or pair you with other users utilising the same or nearly the same amount of usage.

VpsCity have the right to change any term from time to time without prior notice.
